1. Scope of Services

Open G operates a digital intelligence and decision infrastructure platform designed to analyze, evaluate, classify, and support optimization across digital ecosystems. Our services may include, without limitation:

• Domain and digital property audits
• Traffic quality analysis
• Monetization readiness diagnostics
• Infrastructure and ad stack detection
• Benchmarking and tier classification
• Automated recommendations and alerts
• Social automation tools
• Decision-support dashboards
• Monetization activation frameworks
• Data enrichment and structured intelligence outputs

All Platform outputs are analytical and decision-support in nature unless otherwise expressly agreed in writing.

2. Eligibility and Account Access

You must be legally capable of entering into a binding agreement to use the Platform. You are responsible for maintaining the confidentiality of your login credentials, all activity occurring under your account, and ensuring your use complies with applicable laws and regulations. Open G reserves the right to suspend or restrict access if misuse or risk is detected.

3. Analysis of Publicly Accessible Digital Properties

3.1 Public Data Analysis

Open G may analyze websites, domains, or digital properties using publicly accessible information, including but not limited to technical infrastructure signals, observable monetization configurations, ad stack detection, traffic-related indicators, and publicly visible metadata. Such analysis may occur regardless of whether the property owner is a customer or has a direct commercial relationship with Open G.

3.2 No Ownership or Authorization Required

Because Open G operates on publicly accessible information, Open G does not require ownership, authorization, or prior notice to analyze a digital property. Open G does not claim ownership over analyzed properties or their content.

4. Platform Outputs and Decision Support

The Platform may generate audit reports, scores and readiness indicators, classifications and tiers, risk and quality signals, monetization optimization suggestions, buyer-side and seller-side decision outputs, structured data insights, and automation recommendations. All outputs are informational and analytical. They do not constitute legal advice, financial advice, investment advice, or performance guarantees. Users remain fully responsible for any commercial or operational decisions made based on Platform outputs.

5. Monetization and Execution Services

Unless explicitly agreed in a separate written agreement: Open G does not execute media buying by default, does not operate as a registered DSP or SSP, does not resell inventory, does not arbitrage traffic, does not generate artificial traffic, and does not guarantee revenue or performance outcomes. Where Open G provides execution services (including monetization management, campaign management, demand integration, or other activation services), such services are governed by separate written agreements.

6. User Responsibility

By using the Platform, you acknowledge that final commercial, media, and technical decisions remain your responsibility, Platform outputs are analytical tools not guarantees, you assume full risk for how outputs are used, and you are responsible for compliance with third-party policies (including advertising platforms and exchanges). Open G is not liable for actions taken based on Platform-generated insights.

7. Acceptable Use

You agree not to use the Platform in violation of applicable laws, misrepresent Platform outputs as guarantees or endorsements, attempt to reverse engineer or extract proprietary models, interfere with Platform security or infrastructure, use outputs for unlawful scraping or abusive conduct, or use the Platform to engage in fraudulent, manipulative, or deceptive practices. Open G reserves the right to suspend access for misuse.

8. Fees and Billing

Access to certain products or features may be subject to subscription fees, usage-based pricing, or enterprise agreements. Pricing terms are described at the time of purchase or in applicable agreements. Execution, monetization, or enterprise services are governed separately and may include revenue share or service fees as agreed in writing. All fees are non-refundable unless otherwise specified.

9. Intellectual Property

All Platform technology, models, scoring systems, classifications, dashboards, and proprietary frameworks are the intellectual property of Open G. You may not copy, replicate, redistribute, reverse engineer, or commercially exploit any proprietary component without written authorization. Users retain ownership of their own submitted data.

10. Suspension and Termination

Open G may suspend or terminate access if these Terms are violated, usage poses legal, operational, or security risk, required fees are unpaid, or misuse or fraudulent activity is detected. Upon termination, access to the Platform may be revoked, subject to applicable agreements.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available". Open G disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy of results, and revenue performance. We do not guarantee uninterrupted or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by law, Open G shall not be liable for indirect damages, loss of profits, loss of data, business interruption, or consequential damages arising from use of the Platform. Total liability shall not exceed fees paid to Open G in the preceding twelve (12) months.

13. Modifications

Open G reserves the right to modify these Terms at any time. Updated Terms will be posted on OpenGScale.com with a revised effective date. Continued use of the Platform constitutes acceptance of updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
